Hip hop star Kodak Black has been hit with a rape charge after prosecutors say he attacked a high school student in a hotel room in 2016 after performing at a show in South Carolina.

The rapper, real name Dieuson Octave, will likely have to return to the state this year to face the charge of first-degree criminal sexual conduct. The hitmaker is currently on tour in the Southeast, but a local prosecutor tells The State that he will likely have to return to South Carolina either in the summer or early fall.

“I’m hoping to get it up for disposition by then,” said 12th Circuit Solicitor Ed Clements in an interview on Thursday. He also noted that a trial tentatively set for April has been continued and no new date has been set.

The alleged victim, who was not a minor at the time of the crime, did not immediately report the assault to law enforcement. Instead she reportedly told a nurse at Richland County high school, who informed the resource officer before the Florence County Sheriff’s Office eventually learned of the incident, according to WPDE.

According to the arrest warrant, Kodak Black—who has been “arrested four times in Florida”—forced the girl onto the floor of the hotel room where he sexually assaulted her, although she “repeatedly told the defendant no and to stop. The defendant did not stop.” The report also states he bit her on the “neck and her right breast.” The injuries were documented in a rape kit.

After the artist was released on a $100,000 bond, he agreed to a DNA swab, Clements told The State.

“We are slowly but steadily moving toward a disposition,” said Clements.

If convicted, Kodak Black could face a maximum sentence of 30 years in prison.
